Pursuant to the Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal information/data may be processed by KUVEYT TÜRK KATILIM BANKASI A.Ş., with its registered head office at Büyükdere Cad. No: 129/1 Esentepe / Şişli / İstanbul and MERSIS number 0600002681400074, in its capacity as data controller; within the framework set forth under the KVKK, your personal data may be recorded, stored, updated, disclosed to third parties where permitted by legislation, classified, and processed in the manners specified under the KVKK. Details on the matter and your rights are summarized below for your information.
1. Since all information belonging to you, including your name, surname, phone numbers (work, mobile, fax), email address, address, Turkish Republic identification number, date of birth, place of birth, father’s name, profession, sector of employment, education, source of income, purpose of account, number and volume of transactions (and other identity verification information required under MASAK legislation), as well as voice recordings of your phone calls, constitutes “personal data”; such data may be processed by our Bank, in its capacity as Data Controller, for the purposes of enabling you to give instructions and carry out transactions on behalf of our customer, ensuring instruction, confirmation and verification methods for transactions to be carried out on behalf of our third-party customer, establishing your authorization definition within our Bank, and conducting your identity verification in this context, based on the legal grounds set forth under Article 5/2(c) of the KVKK (being directly related to the establishment or performance of a contract and the necessity of processing personal data belonging to the parties of the contract) and Article 5/2(ç) of the KVKK (being mandatory for the data controller to fulfill its legal obligations).
2. Your processed personal data may be transferred, in accordance with Article 8 of the KVKK, for the above-mentioned purposes and upon request, to all institutions and organizations stipulated by the legislation, and where necessary, to public authorities including but not limited to the Banking Regulation and Supervision Agency (BDDK), Financial Crimes Investigation Board (MASAK), and courts.
3. Your personal data may be obtained through automatic or non-automatic methods, including but not limited to the Communication Tools Agreement, ADK forms and other representation documents, proxy documents, electronic mail and phone communications, and any information and statements you may provide, particularly within the scope of the services requested from our Bank by the company that designates you as an authorized person.
4. Your personal data may be retained for the duration required by the purposes of processing. In the absence of any other justification or legal basis, international laws or regulations, or contractual obligations, personal data whose processing purposes have ceased shall be deleted, destroyed, or anonymized.
5. By applying to our Bank, you have the right to learn whether your personal data is processed, to request information if your personal data has been processed, to learn the purpose of processing your personal data and whether they are used in accordance with such purpose, to learn the third parties to whom your personal data is transferred domestically or abroad, to request correction of your personal data if it is incomplete or incorrectly processed, to request deletion or destruction of your personal data within the conditions stipulated under Article 7 of Law No. 6698, to request notification of such deletion or destruction to third parties to whom your personal data has been transferred, to object to the occurrence of a result against you by analyzing your processed personal data exclusively through automated systems, and to request compensation for damages in case you suffer damage due to unlawful processing of your personal data. If exercising the above rights requires additional costs, a fee will be charged in accordance with the relevant legislation. You may exercise these rights through the communication channels below in accordance with Article 11 of Law No. 6698.
