Protection Of Personal Data For Banking Transactions

INFORMATION ON THE PROTECTION OF PERSONAL DATA

Pursuant to the Law No. 6698 on the Protection of Personal Data (“LPPD”), your personal information/data will be saved, stored, updated and processed in the manner specified in LPPD within the framework described in LPPD. The details on the topic and your rights are summarized below for information purposes.

1. Since any information about you, including your name, surname, phone number (business, mobile, fax), e-mail address, address, audio recordings of your phone calls, Turkish Republic identity number, date of birth, place of birth, father’s name, which is transmitted to us by our bank’s customer and/or by you for the purpose of authorizing you with the Communication Tools Agreement, is within the scope of “personal data”, your personal data will be processed by our Bank in the capacity of Data Controller for the realization of the definition of official to be attributed to you for the purpose of providing the instructions, confirmation and verification methods that you will use under the Communication Tools Agreement Pursuant to article 5/2 of LPPD; the legal reasons for the processing of your personal data are that it is necessary to process the personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract.
2. Your processed personal data may be transferred to all institutions and organizations stipulated by the legislation for the above purposes and upon request and to the public authorities including BRSA, MASAK, and courts if necessary. In addition, your personal data may also be shared with national or international (FATCA or similar) institutions or organizations in the event that the provisions of the national or international legislation with which the our Bank is obliged to comply and the national or international conventions to which it is a party require it or in the event compliance with legislation and conventions is necessary for the interests of our Bank and/or the group/affiliates to which it is involved, even if our Bank is not a direct party to them and it is not directly compulsory,
3. Your personal data may be obtained through automatic and non-automatic methods such as the Communication Tools Agreement with which the company identifying you as authorized, declares that it has authorized you within the scope of the service it wish to receive from our Bank, electronic mail and telephone calls, if any, information and declarations to be provided by you.
4. You have the right to apply to our bank to find out if your personal data has been processed, to request information if your personal data has been processed, to learn the purpose of processing your personal data and whether it has been used for its purpose, to learn about third parties, to whom your personal data have been transferred at home or abroad, to request correction of your personal data in case of incomplete or incorrect processing, to request the deletion or destruction of your personal data in accordance with the conditions stipulated in Article 7 of the Law no: 6698 on the Protection of Personal Data, to request to provide information to the third parties to whom they have been transferred if your personal data is deleted or destroyed for the reasons above, to object to the occurrence of an outcome against you by analyzing your processed personal data exclusively through automated systems, to claim damages if you suffer damage due to unlawful processing of your personal data. When exercising your rights above, if the transaction requires additional costs, you will be charged in accordance with the applicable legislation. You may exercise your rights through the following communication channels in accordance with the relevant Article 11 of the Law No. 6698
